Judicialização da violência doméstica: a nova visão da legislação brasileira a respeito da violência psicológica contra a mulher

Abstract

ABSTRACT This article reports the context of the judicialization of the legislative innovation of Domestic Violence with the particularity of Psychological Violence Against Women, based on the Maria da Penha Law, the Brazilian Penal Code and Brazilian scholars. Given this, it aims to show that psychological violence starts in the family environment, highlighting that one type of violence leads to another and presenting the damage caused to the victims and the punishments which should be imposed on the aggressors. The chosen method was the deductive one, which allows the analysis of the theme approached through researches that allow the reasoning so that there is a particular conclusion in the elaboration of the work. Given this, it is concluded that despite all the evolution that Women's Rights has been going through, many are still attacked and have no escape or means of defense, being a problem that lasts over time and needs to end so that women feel be safe and be free.
