Abstract

Cruelty to Domestic Animals in Light of Brazilian Legislation The present study examined the legal protection of domestic animals in Brazil, highlighting the persistence of animal abuse despite the existence of protective legislation. The research supported the hypothesis that legislative inadequacy is one of the primary reasons for the continuation of these abuses, even with the historical evolution in perceiving animals as subjects of rights. The analysis revealed challenges in the effective enforcement of legislation and difficulties in raising awareness within society regarding responsible pet ownership and respect for animal rights. By examining emblematic cases and international experiences, this study underscored the urgent need for measures to enhance the protection of domestic animals in Brazil. The qualitative research, based on literature review and the analysis of data from academic databases, led to conclusions that urge both society and lawmakers to take actions that strengthen legislation, promote awareness, and ensure fair and humane treatment of animals. This work contributes to a broader understanding of the causes and solutions for animal abuse within the Brazilian legal framework and emphasizes the perspective that animals are sentient beings deserving of respect and protection, rather than mere property.
