O direito fundamental à saúde: a judicialização como meio para efetividade do acesso à saúde pela coletividade

Abstract

The objective of this article is to investigate the judicialization of health in the struggle for the right to health, seeking to assess the interference of the judiciary in guaranteeing and implementing the right to health, showing the rights provided for in the Federal Constitution and evaluating the effective performance of the SUS in health care. . The aim is to answer the following problems: Is it the role of the Judiciary to interfere in the health area due to an emergency? What are the public policies to meet and guarantee the right to health? Does the effective performance of the SUS to serve the population, does the financial issue prevent the SUS from providing adequate care? Analyze and discuss the demands of health service users who seek, through the courts, to ensure the right to health in the State of Goiás, the objective of this study. An initial methodological path was traced in a documentary research of secondary and primary sources.
