| Resumo: | O presente artigo tem como objetivo verificar como é estruturada a sistemática da Segurança Pública no Brasil e quais são os órgãos responsáveis por exercê-la, bem como analisar os limites de atuação das Guardas Municipais. Dentro desta perspectiva de análise, este estudo conceituou o poder de polícia administrativa, examinou quais são as atribuições constitucionalmente estabelecidas às Guardas Municipais e se estas não estão extrapolando este limite. Além disso, inferiu-se como a regulamentação infraconstitucional regulamentou normas gerais para padronizar a criação desta instituição. Para isso, foi utilizado estudos da Carta Magna, de doutrinas, leis e artigos da internet relacionados com o tema. |
| Abstract: | This article aims to verify how the system of Public Security in Brazil is structured and which are the agencies responsible for exercising it, as well as to analyze the limits of action of the Municipal Guards. Within this perspective of analysis, this study conceptualized the power of administrative police, examined what are the constitutionally established attributions to the Municipal Guards and if they are not extrapolating this limit. In addition, it was inferred how the infraconstitutional regulation regulated general norms to standardize the creation of this institution. For this, studies of the Magna Carta, doctrines, laws and internet articles related to the subject were used. |
