Abstract

This study explored the complex legal relationship that permeates traffic accidents, investigating the interaction between the criminal and civil spheres. Initially, it sought to contextualize the alarming scenario of accidents in Brazil, outlining the legal framework that governs them. It then delved into the foundations and institutes of civil law, examining the driver's liability and the duty to repair the damage caused to the victim. Next, the focus turned to the criminal sphere, addressing the crucial distinction between intent and fault in the agent's conduct, as well as the criminal types that apply to traffic events. It also sought to understand why tragedies involving accidents have become so common in our country.
