Tutela jurisdicional dos animais de estimação como seres sencientes no direito comparado

Abstract

The present work had as objective to open the range of understandings on the protection of animals in the social scope, demonstrating, this time, that the protection of them as subjects of rights is of paramount importance. With that, a gradual question of social evolution in Brazil was presented, addressed in the fields of society, starting from the historical social evolution and ending with legal updates in this field. The existence of social roles that originate from a socio-cultural model and influences the way animals are treated. How small attitudes, which can sometimes go unnoticed, or even be minimized, influence the legal field. This influence results in poor laws in the fields of animal rights protection. The known work that is of paramount importance to recognize the existence of animals as human beings, that despite their reduced capacity compared to humans, they understand things. And the measures exposed in this work are essential for the social conception of the position that the animal occupies to be modified. Therefore, with a greater awareness of mistreatment, abandonment, cruelty, plus an education aimed at promoting education to people in relation to this theme, that animals are beings that feel, as well as humans, greater protection of States and policies that can change the environment in which they live, so that this reflects in the elaboration of better laws that can protect them from the cruel situations that surround them today, or who knows, even, a Special Statute.
