Lei Maria da Penha: a eficácia da aplicação das medidas protetivas de urgência da Lei 11.340/06

Abstract

This article aims to demonstrate the importance of protective measures imposed by the Maria da Penha Law to combat domestic violence, studying domestic violence in Brazil, verifying the position of the Federal Constitution and analyzing some of the different types of domestic violence. The research also addresses Law 11.340/06 and the protective measures provided for against the aggressor and for the protection of the victim, where the applicability and effectiveness of the protective measures imposed by Law Maria da Penha was verified. The research method used in this scientific article was the bibliographical method with the deductive method in order to understand the change in Law 11.340/06 in the fight against domestic violence against women, understanding the ways of applying the protective measure in the face of different types of violence existing domestic violence against women. It is concluded that protective measures emerged with the sole purpose of helping women who experience domestic violence, where the application of these measures is currently the greatest security instrument for women in situations of domestic violence, with constant and promising advances , so that the suffering of these women is increasingly reduced and that they become aware of the need to denounce and the duty to respect everyone, regardless of gender.
