A violência doméstica e o feminicídio no âmbito jurídico brasileiro: a efetividade das Leis 11.340/2006 e 13.104/2015 no Estado de Goiás

Abstract

ABSTRACTThe objective of this scientific article is to identify the current situation of our prison system in relation to the dignity of the human person and present the support of legislation, such as the Federal Constitution of 1988, which prioritizes the dignity of the human person as one of the func-tions. main elements of the legal system, with a focus on the good of all, without prejudice of origin, race, sex, color, age and any other forms of discrimination. The method-ology used in this research was a bibliographic review based on the analysis of specialized, renowned doctrines and in addition to sources such as legislation, jurisprudence and related scientific articles. When dealing with the dignity of the human person, it is necessary to ana-lyze the position of the Brazilian State regarding the implementation of the rights and princi-ples guaranteed to detainees, since no one will be subjected to torture or inhuman or degrad-ing treatment. Therefore, it is important to analyze the application of penalties in accordance with criminal enforcement legislation, whose article provides that the intimacy, private life, honor and image of people are inviolable, with the right to compensation for the damage be-ing ensured. material or moral, arising from its violation. However, such precepts are not always in line with specific laws, given the situation of Brazilian prisons whose environment is often degrading and inhuman due to overcrowding, the absence of medical care, the pre-cariousness in food and lack of hygiene that can trigger various diseases, even leading to death in prisons. This situation meets the main purpose of the penalty, which is the rehabilita-tion of the prisoner, compatible with the right and duty to punish individuals who commit criminal offenses, in order to safeguard peace and social security, preventing imprisonment from becoming a crime industry as stated by most of the doctrine and which is consistent with the object of this research.Keywords: Detainees; Dignity of human person; Penal execution; Resocializatio;Prison.
