Resumo: | Este trabalho monográfico investiga, a partir de uma perspectiva analítico-explicativa, o surgimento e a evolução do Direito Internacional e dos Direitos Humanos no pós-Segunda Guerra Mundial, sublinhando suas influências para a positivação e valoração na Carta das Nações Unidas em 1945, tais como: a apreciação da condição humana; o acatamento aos princípios das relações internacionais e o cumprimento das normas jurídicas internacionais. Para tal, utiliza-se o método qualitativo-analítico que se concebe fundamental para embasar a consolidação do Direito Internacional e dos Direitos Humanos na garantia e proteção da dignidade humana e da harmonia jurídica internacional, elegendo uma vasta revisão bibliográfica para realizar o diálogo entre os autores das obras estudadas. Apresenta de forma direta e transparente a repercussão dos crimes contra a humanidade, o desacatamento dos princípios das relações internacionais e da transgressão das normas jurídicas internacionais, perpetrados pelo regime nazista durante a Segunda Guerra Mundial (1939-1945). Para o Sistema Internacional tais crimes traduziram-se como efeito na criação da Organização das Nações Unidas, na Declaração Universal dos Direitos Humanos e na Convenção para a Prevenção e Repressão do Crime de Genocídio. |
Abstract: | This monographic work investigates, from an analytical-explanatory perspective, the emergence and evolution of International Law and Human Rights in the post-World War II era, underlining its influences for the positivation and appreciation of the United Nations Charter in 1945, such how: the appreciation of the human condition; adherence to the principles of international relations and compliance with international legal norms. To this end, the qualitative-analytical method is used, which is considered fundamental to base the consolidation of International Law and Human Rights in guaranteeing and protecting human dignity and international legal harmony, choosing a vast bibliographic review to carry out the dialogue between authors of the studied works. It directly and transparently presents the repercussions of crimes against humanity, the disregard of the principles of international relations and the transgression of international legal norms, perpetrated by the Nazi regime during the Second World War (1939-1945). For the International System, these crimes resulted in the creation of the United Nations, the Universal Declaration of Human Rights and the Convention for the Prevention and Suppression of the Crime of Genocide. |
