dc.description.abstractThe scientific article deals with the protection of domestic animals in today's world, with the prohibition of the sale of these animals by pet shops and establishments, the evolution of the civilizing process, with the change of thoughts and the advancement of STJ decisions (RESP 1,797,175/ SP), which admitted the ecological dimension of the dignity of humans and non-human animals, recognizing animals as subjects of rights, as sentient beings and, therefore, holders of interests that must receive protection from the legal system. An incursion will also be made on Federal Law 14,064/2020, as well as an analysis that the legal system cannot simply relegate the relationship between man and his animal to a secondary level. The bibliographic and documentary research started from a bill in the city of São Paulo, regulating the sale of dogs and cats, allowing the analysis of data collected using the deductive method. It is concluded that there is an increasing philosophical, social, cultural and legal consensus that the animal needs to have its nature as a sensitive living being recognized, especially domestic animals, members of new families (multiple species), so that they do not there is inconsistency in the legal regime for animals.pt_BR

dc.description.resumoO artigo cientifico trata da proteção dos animais domésticos no mundo atual, com a proibição da comercialização desses animais pelos pet shops e estabelecimentos, a evolução do processo civilizatório, com a mudança de pensamentos e o avanço das decisões do STJ (RESP 1.797.175/SP), que admitiu a dimensão ecológica da dignidade da pessoa humana e dos animais não-humanos, reconhecendo aos animais o status de sujeito de direitos, como seres sencientes e, por conseguinte, titulares de interesses que devem receber a proteção do ordenamento jurídico. Far-se-á ainda uma incursão na Lei Federal 14.064/2020, bem como analisar-se-á que o ordenamento jurídico não pode, simplesmente, relegar a um plano secundário a relação do homem com seu animal. A pesquisa bibliográfica e documental partiu de um projeto de lei da cidade de São Paulo, regulamentar a comercialização de cães e gatos, permitindo a análise dos dados coletados pelo método dedutivo. Conclui-se que há cada vez mais um consenso filosófico, social, cultural e jurídico de que o animal precisa ter reconhecida a sua natureza de ser vivo sensível, ainda mais os animais domésticos, integrantes das novas famílias (multe espécies), para que não haja incongruência no regime jurídico dos animais.pt_BR
