Título:	Omissões dos planos de saúde no tratamento do transtorno do espectro autista no Brasil

Resumo:	Este estudo analisou a efetivação do direito à saúde das pessoas com Transtorno do Espectro Autista no âmbito dos planos de saúde, perante as recorrentes negativas de cobertura de tratamentos multiprofissionais. A pesquisa fundamentou-se na análise legislativa, doutrinária e jurisprudencial, dentro do marco regulatório da Agência Nacional de Saúde Suplementar, órgão responsável por regulamentar a saúde privada, e nos entendimentos consolidados pelo Superior Tribunal de Justiça e Supremo Tribunal Federal em julgamentos de temas correlatos ao estudo. O trabalho investigou a aplicabilidade da Lei Berenice Piana (Lei n.º 12.764/2012) e das Resoluções Normativas regulamentadas pela ANS, como a 469/2021, que estabeleceu a cobertura obrigatória e ilimitada de terapias. Os resultados demonstraram que uma das formas para se alcançar o tratamento na saúde suplementar é por meio da judicialização das demandas referentes ao TEA, pois os planos de saúde não adotam o mesmo entendimento previstos nas Leis, normativas, entre outras questões. Conclui-se que, apesar do avanço normativo, a intervenção judicial permanece indispensável, na maioria dos casos, para superar as barreiras impostas ao tratamento das pessoas dentro do Espectro Autista. ABSTRACT This study analyzed the effectiveness of the right to health of people with Autism Spectrum Disorder within the scope of health plans, in view of the recurrent denials of coverage of multiprofessional treatments. The research was based on legislative, doctrinal and jurisprudential analysis, within the regulatory framework of the National Supplementary Health Agency (ANS), a body empowered to regulate private health and also on the understandings consolidated by the STJ and STF with judgments on the respective themes of the study. The work investigated the applicability of the Berenice Piana Law No. 12,764/2012 and the Normative Resolutions regulated by the ANS such as: 469/2021, where it established the mandatory and unlimited coverage of therapies. The results showed that one of the ways to achieve treatment in supplementary health would be the judicialization of the demands related to the disorder under study, as health plans do not cooperate with the same understanding of the Laws, regulations, among other issues. Thus, the understanding was formulated in several courts and tribunals of the STF, as it covers the principles of human dignity, the social function of the contract and objective good faith. It is concluded that despite the normative advance, judicial intervention remains indispensable in most cases to overcome this barrier imposed on the treatment of people within the Autistic Spectrum.
